Terms of service for Modula-Instagram

These Terms of Service (“Terms”) govern your use of the Modula-Instagram WordPress plugin (“Plugin”). By installing and using the Plugin, you agree to be bound by these Terms. If you do not agree with these Terms, please do not install or use the Plugin.
1. License and Use of the Plugin
License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Plugin solely for its intended purpose of integrating Instagram functionality into your WordPress website.
Permitted Use: The Plugin allows you to authenticate your Instagram account, retrieve Instagram media, and display it on your WordPress website.
Restrictions: You may not modify, reverse-engineer, or otherwise tamper with the Plugin’s code, unless explicitly permitted under applicable open-source licenses (if any).
2. User Responsibilities
Authentication Flow: You are responsible for securely managing your Instagram account, including the security of the access tokens stored on your website’s database after authentication via the Plugin.
Compliance: You must comply with all applicable laws and Instagram’s Terms of Service and Privacy Policy when using the Plugin to interact with Instagram.
Third-Party Content: You are solely responsible for ensuring that any content (e.g., images) you retrieve from Instagram complies with applicable copyright laws and does not infringe the rights of any third parties.
3. Data Handling
No Data Retention: We do not store any access tokens, Instagram account information, or other personal data on our servers. The Plugin acts as a temporary proxy to facilitate the OAuth authentication flow, with all access tokens and user data stored locally on your website’s database.
Security: You are responsible for maintaining the security of your WordPress installation, database, and any data retrieved through the Plugin, including the Instagram access token.
4. Limitation of Liability
Disclaimer: The Plugin is provided “as is,” without any warranties, express or implied, including but not limited to warranties of fitness for a particular purpose, merchantability, or non-infringement. We make no guarantees regarding the availability, reliability, or functionality of the Plugin. No Liability for Third-Party Services: We are not responsible for the functionality, availability, or privacy practices of third-party services such as Instagram. Any issues with Instagram’s API or services should be resolved directly with Instagram.
Liability Limitation: To the fullest extent permitted by law, we shall not be liable for any damages (including but not limited to direct, indirect, incidental, special, or consequential damages) arising from the use of or inability to use the Plugin, even if we have been advised of the possibility of such damages.
5. Termination
We reserve the right to terminate or suspend your access to the Plugin at any time, without notice, if you violate these Terms or if we discontinue the Plugin. Upon termination, you must stop using the Plugin and remove it from your website.
6. Changes to the Terms
We may update these Terms from time to time. When we make changes, we will post the updated Terms on our website or through the Plugin, with the “Effective Date” noted at the top of this page. Your continued use of the Plugin after the effective date constitutes your acceptance of the updated Terms.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles.
